In a peculiar turn of events during a hearing on a trademark dispute between Pernod Ricard and JK Enterprises, Senior Advocate Mukul Rohatgi requested permission to present two whiskey bottles as evidence.
Pernod Ricard accused JK Enterprises of copying the trademark Blenders Pride, alleging similarities in the London Pride brand and Imperial Blue whiskey's color combination, get-up, and trade dress. During the hearing, Rohatgi, while arguing, produced the bottles, aiming to showcase the alleged resemblances.
Chief Justice of India DY Chandrachud responded with humor, exclaiming, "You brought bottles with you?" Rohatgi explained the necessity to highlight product similarities. The CJI acknowledged the issue concerning trade dress and, referring to a past judgment, stayed the Madhya Pradesh High Court's order.
The court issued a notice to bar JK Enterprises from producing and selling beverages resembling Pernod Ricard's brands. The hearing is scheduled for two weeks later.
